Exemption Eligility Requirements For Workers Compensation Insurance Coverage

For Construction Industry Applicant

Corporations:

  • A corporation must be registered and listed as active with the Florida Department of State, Division of Corporations.
  • The applicant must be registered to 10 percent ownership of the corporation
  • $50.00 application fee is required.
  • Construction exemptions are valid for 2 years or until a revocation is filed.

Limited Liability Company (LLC):

  • The LLC must be registers and listed as active with the Florida Department of State, Division of Corporations.
  • The applicant must be registered to a minimum of 10 percent ownership of the LLC.
  • No more than three officers of an LLC may elect to be exempt.
  • Construction exemptions are valid for 2 years or until a revocation is filed.

For Non-Construction Industry Applicant

Corporations:

  • The Corporation must be registers and listed as active with the Florida Department of State, Division of Corporations.
  • The applicant is required to be listed as an officer of the corporation in the records of the Florida Department of State.
  • No limit to the amount of corporate officers eligible to obtain an exemption.
  • No application fee.
  • Non Construction exemptions effective on the first and after are valid for 2 years or until a revocation is filed or until revoked by the division

Limited Liability Company (LLC)

  •  The Corporation must be registers and listed as active with the Florida Department of State, Division of Corporations.
  • The applicant must evidence a minimum of 10 percent ownership of the LLC.
  • No more than 10 members of an LLC may elect to be exempt.
  • No application fee.
  • Non Construction exemptions are valid for a period of 2 years or until a revocations is filed or until revoked by the division.
  • The effective and expiration dates are listed on the Certificate of Election to be exempt.
