What type of incidents are covered by workers compensation insurance?
Workers compensation is designed to cover injuries that result from the employers or employees carelessness. The law covers all accidental injuries and disease arising from the course of employment. This includes disease / infections resulting from such injuries. It also covers death resulting from such injuries with a specified period of time.
It is important to note that if you do not think an injury is covered, you must file a First Report of Injury or Illness with your insurance carrier for determination of responsibility within seven days of the accident.
What type of injuries are not covered by workers compensation?
Florida workman’s compensation law does not provide compensation for the following scenarios:
- Nervous or mental impairment due to stress or excitement.
- A work related incident that results in an employee have fear or dislike to another person in regards to the person’s color, race, religion, gender, national origin, handicap, or age.
- The employer may not file suit against an injured worker for causing a catastrophe nor may the injured worker sue the employer for injury.
